About the GranuFlo Settlement

In February 2016 Fresenius announced that they reached an Agreement In Principle with a committee designated by Plaintiffs to resolve litigation in the U.S. involving GranuFlo and NaturaLyte.  Under that Agreement the GranuFlo settlement would be $250 million, provided that 97% of the plaintiffs agree to the settlement by July 2016.  If the plaintiffs agree, the settlement will be funded in August 2016.  Fresenius posted an article on their website stating, “Insurers will fund the settlement amount with $220 million”.  “The company expects a pre-tax charge of $60 million from the settlement and other costs to finalize this matter.”

The settlement distribution is to be based on individual factors and circumstances, namely the severity of damage and the financial consequences incurred from the use of GranuFlo and NaturaLyte.

The most common under consideration:

  • The pain and mental anguish experienced in the past and expected to suffer in the future.
  • The degree and duration of injury experienced due to the use of GranuFlo and NaturaLyte during dialysis treatments.
  • What effect the damage had on the general physical and mental health or well-being of the patient.
  • The cost of past or future medical expenses.
  • Loss of ability to work or earn a living.
  • Lost wages.
  • The cost of funeral expenses incurred as a result of a death caused by GranuFlo or NaturaLyte.

Despite agreeing to a GranuFlo settlement, Fresenius stands behind the safety of their products.  Both drugs remain on the market and “continues to be the market leader for dialysis acid concentrates in the United States.” The product composition has not been altered and FMC contends, “remains safe and effective when used as prescribed and directed.”

Join the GranuFlo Lawsuit
